JOHOR BARU: 6 Nov -- Two factory operators escaped the gallows after they were acquitted of trafficking almost 2kg of cannabis at a High Court here.
T. Gunalan, 31, and M. Bala- krishnan, 28, were charged with trafficking 1,896.85g of the drug in front of an entertainment outlet in Taman Pelangi on April 19, 2005.
Police discovered a bagful of drugs in Gunalan’s car at the time of the arrest.
Their offence was classified under Section 39B of the Dangerous Drug Act 1952, which carries the mandatory death sentence upon conviction.
Defence counsels G. Subramaniam Nair and S. Vijayaratnam argued that Gunalan’s car had been borrowed by a man named Satiskumar, nicknamed “Boy,” an hour prior to the arrest.
“This ‘Boy’ could have been the one who put the drugs in the car. Both accused were arrested after ‘Boy’ returned the car to them,” they said.
High Court Judge Datuk Syed Ahmad Helmi Syed Ahmad ruled in favour of the defence.
“It could have been kept by ‘Boy’ before he returned the car to the accused,” he said.
Both accused cried in relief along with other family members after the judgment was read out.
